The Centers for Medicare and Medicaid Services (CMS) issued major revisions to the Conditions of Participation (CoP) manual for both prospective payment system (PPS) hospitals and critical access hospitals (CAHs) this month. For CAHs, more than one-third of the manual has been revised. To help hospitals understand how the latest changes will affect them, KHREF will host two seminars in July:

KHA is extending the deadline for the AHA Annual Survey for your fiscal year 2014.  Kentucky hospitals will have until June 19 to complete the AHA Survey.

On Tuesday, May 26, the Centers for Medicare and Medicaid Services (CMS) released a proposed rule that would update Medicaid and Children’s Health Insurance Program (CHIP) managed care regulations to better align them with existing commercial, Marketplace and Medicare Advantage regulations. The proposed rule, which is the first major update to Medicaid and CHIP managed care regulations in more than a decade, includes updates to managed care provider networks, quality measures, external quality review, and beneficiary rights and protections.

KHA staff is analyzing the rule for comments, which are due to CMS by July 27. KHA also submitted issues to CMS via AHA for their consideration in drafting the proposed rule to address problems experienced with managed care in Kentucky.

The regulation proposes a minimum medical loss ratio (MLR) of 85 percent beginning in 2017, standards around actuarial soundness of capitation rates, contracting standards and consumer protections. To read the entire rule, see...

KHA will host an advocacy trip to Washington, DC, on July 16 -17 for Kentucky hospital leaders. Participants will meet with the Kentucky congressional delegation at their Capitol Hill offices on Thursday, July 16 and will host a luncheon meeting and briefing for the health aides on Friday, July 17.

This is an excellent opportunity to meet with your federal legislators to share the challenges Kentucky hospitals are facing.

Earl Feezor, longtime administrator of Western Baptist Hospital in Paducah and former Chair of the KHA Board of Trustees, passed away this week at his home. Earl's dedication to health care in the commonwealth leaves a lasting legacy for the people of Paducah and beyond.

On May 14, the Cabinet for Health and Family Services (CHFS) released proposed changes to the State Health Plan (SHP). There are significant and comprehensive changes included and many of them are of concern to Kentucky hospitals. Of particular concern are changes to the Ambulatory Surgery Center (ASC) criteria.

Please review KHA's high-level summary of the changes, and the red-lined version of the SHP for information on the proposed changes.

KHA will be analyzing the proposal in much more detail and looks forward to hearing comments from members.

The highlight of the luncheon was the installment of the 2015-2016 Chair of the KHA Board of Trustees, Kevin Halter, system chief executive officer of Bon Secours Kentucky Health System, which includes Our Lady of Bellefonte Hospital in Ashland. Halter will begin his tenure as Chair on July 1.

On Friday, May 15, the Cabinet for Health and Family Services (CHFS) will host a forum on the role of Kentucky's rural hospitals in the State Innovation Model (SIM) health system transformation project that is underway in Kentucky. It will be held from 9:00 a.m. to 12:00 p.m. (ET) at the Department of Public Health Conference Suites in Frankfort. The meeting will explore health system transformation models that have proven effective for smaller and rural hospitals in other states, and the potential relevance of the models to Kentucky.

During the week of July 20 through 24, a final sample group of providers will have the opportunity to participate in ICD-10 end-to-end testing with Medicare Administrative Contractors (MACs) and the Common Electronic Data Interchange (CEDI) contractor. The Centers for Medicare and Medicaid Services (CMS) is accepting additional July volunteers from May 11 through 22. This is an excellent opportunity to participate in end-to-end testing with Medicare prior to the October 1, 2015, implementation date.

Approximately 850 volunteer submitters will be selected to participate in the July end-to-end testing. This nationwide sample will yield meaningful results, since CMS intends to select volunteers representing a broad cross-section of provider, claim and submitter types, including claims clearinghouses that submit claims for large numbers of providers. Note: Testers who are participating in the January and April end-to-end testing weeks are able to test again in July without re-applying.

On Friday, May 8, KHA hosted a press conference to announce the publication of a new report outlining the changes Kentucky hospitals are facing in the wake of the nearly $7 billion in federal cuts they will suffer through 2024.

The report details an analysis, by the national consulting firm of Dobson/DaVanzo, of the impact these payment cuts will have on the financial bottom line of Kentucky hospitals. The analysis found Kentucky hospitals will lose more money than they gain in new revenue from expanded health insurance coverage. KHA supports the governor’s decision to expand Medicaid and the significant revenue it generates; however, the new expansion revenue is less than the cuts Kentucky hospitals will experience in order to finance the Affordable Care Act (ACA).

In less than two weeks, U.S. News & World Report will issue its new Best Hospitals for Common Care rating system. U.S. News & World Report will portray data on more than 4,500 hospitals. The system evaluates how well hospitals perform for common conditions and procedures such as heart bypass surgery, hip replacement, knee replacement, heart failure and chronic obstructive pulmonary disease.

Hospitals and health systems have an opportunity to review their data in advance of its publication by logging into the U.S. News Best Hospital Dashboard. On April 30, KHA submitted comments to the Kentucky Office of Legal Services regarding 907 KAR 10:830 on the proposed diagnosis-related group (DRG) reimbursement methodology for the Medicaid fee-for-service population. The Association's comments addressed a long-standing concern and request by the Medicaid Hospital Technical Advisory Committee (TAC) for providing a transition period to new rates and retaining the existing rate appeal process. KHA also requested changes to maintain budget neutrality in updating rates and clarification on several other aspects of the proposed new methodology.
