Cabinet Revises Health Facility Fee Schedule and Licensure Procedures

Hospitals and other health facilities should be aware that the Cabinet for Health and Family Services (CHFS) has filed changes to 902 KAR 20:008 License procedures and fee schedules.
The regulation will go into effect in March. The regulatory changes would:
Require health facilities to obtain a provisional license prior to
operation, which is in effect until the Office of Inspector General conducts
an inspection of the facility and determines the facility is fully
compliant with licensure regulations.
- Require written notice to the Office of Inspector General (OIG) within 30 days in cases of a change of
ownership in a health facility.
- Prohibit an individual or party from acquiring a significant financial
interest in a licensed health facility or service if that party has had a
license or certificate to operate denied, suspended, revoked or voluntarily
relinquished as part of an investigation within the last seven years.
Establish a new section of the regulation on Denial and Revocation of a
license if the provider fails to comply with annual renewal processes or
fails to submit a plan of correction for citations.
